By participating in the Jersey Mike’s Shore Points® Rewards Program (the “Program”), you (“you”) agree to these Program terms and conditions (the “Terms”). Please understand that your use of the Jersey Mike’s® website and mobile app, and any personal information collected by or submitted to Jersey Mike’s and its affiliates, representatives, agents, and employees (collectively, “us”) in connection with your participation in the Program, will be subject to our Privacy Policy and our website Terms of Use.

The Program is offered by Jersey Mike’s Franchise Systems, LLC and its affiliates (herein, collectively “we” or "JMFS"). Jersey Mike's Shore Points (“Shore Points”) may only be used at participating Jersey Mike's locations. Participation in the Program is limited to residents of the United States who are above the age of majority in the state in which they reside. Customer accounts are limited to individuals only and are limited to one account per individual.

You may participate in the Program by providing your first name, last name, and telephone number at a participating Jersey Mike's location and obtaining rewards account identification number (a “Shore Points ID”).

Earn Points

Shore Points may be redeemed for qualifying food and beverage purchases and promotional items only. To earn Shore Points, you must make qualifying purchases at participating Jersey Mike’s locations:

  • For every bag of chips you purchase, you will receive 1 Shore Point;

  • For every cookie you purchase, you will receive 1 Shore Point;

  • For every brownie you purchase, you will receive 1 Shore Point;

  • For every Tastykake you purchase (where available), you will receive 1 Shore Point;

  • For every beverage you purchase, you will receive 2 Shore Points;

  • For every cookie mini pack you purchase, you will receive 2 Shore Points;

  • For every cookie 3-pack you purchase, you will receive 2 Shore Points;

  • For every Hot Chopped Pepper Relish (jar) you purchase, you will receive 2 Shore Points;

  • For every KID’S meal you purchase, you will receive 4 Shore Points;

  • For every Breakfast sandwich you purchase (where available), you will receive 4 Shore Points;

  • For every MINI-size sub you purchase, you will receive 4 Shore Points;

  • For every REGULAR-size sub you purchase, you will receive 6 Shore Points;

  • For every SUB BOWL you purchase, you will receive 6 Shore Points;

  • For every WRAP you purchase, you will receive 6 Shore Points; and

  • For every GIANT-size sub you purchase, you will receive 12 Shore Points.

You must provide your Shore Points ID at the time of purchase to earn Shore Points. For each purchase made using your Shore Points ID, your purchase receipt will show the amount of Shore Points credited to your account for that transaction and point balance. Additionally, no Shore Points are rewarded for amounts paid for tips, gratuities, delivery charges, gift cards, charitable donations, or purchases of non-qualifying menu items; however, purchases made with a gift card will earn Shore Points. Shore Points and earned benefits cannot be transferred to anyone or any other account. Shore Points are only earned by the person who pays for the purchases. Point balances are stored by JMFS’s computer system and are automatically updated after each time you use your Shore Points ID.

Birthday Rewards

You may choose to provide us with your birthday in your MyMike’s account. If you provide this information prior to your birthday, 72 Shore Points will be awarded to your MyMike’s account on your birthday (as indicated in your MyMike’s account) if you meet the following criteria. To qualify, you must: (1) be a MyMike’s account holder, (2) opt into our email program, (3) have provided a birthday in your account information, and (4) have previously purchased at least one order using your MyMike’s account that contains a regular or giant sub, wrap, or sub bowl (“Sub Item”) in the twelve-month period prior to such birthday. Point redemptions do not qualify as a Sub Item purchase. The Sub Item purchase requirement must be satisfied every year to continue qualifying for the birthday reward. An email and push notification (if enabled) will be sent letting you know the points have been awarded, or you can see the award by visiting your Shore Points history page.

Shore Points Redemptions and Restrictions

You can redeem your Shore Points anytime after you reach a qualifying level:

  • You can redeem 48 Shore Points for a free MINI-size sub (Approximate Retail Value (“ARV”) = $7.35);

  • You can redeem 72 Shore Points for a free REGULAR-size sub (ARV = $9.85);

  • You can redeem 72 Shore Points for a free SUB BOWL (ARV = $9.85);

  • You can redeem 72 Shore Points for a free WRAP (ARV = $9.85);

  • You can redeem 144 Shore Points for a free GIANT-size sub (ARV = $17.75);

Shore Points may be redeemed for a base-level sub with no modifications with no purchase required. If you redeem Shore Points for a sub with modifications, you will be responsible for paying for any upcharges. When you redeem your Shore Points, they will be applied to the lowest-priced menu item you order in the applicable point category. For example, if you order two mini-size subs and want to redeem 48 Shore Points, your Shore Points will be applied to the lowest-priced mini-size sub in your order. If you order a regular-size sub and a wrap and want to redeem 72 Shore Points, your Shore Points will be applied to the regular-size sub or the wrap, whichever is lower-priced.

No refunds of Shore Points will be rewarded. If you cancel an order for which you earned Shore Points, or have such an order refunded, any Shore Points associated with that order will be deducted from your Shore Points Card, which may result in you experiencing a negative Shore Points balance.

Offer Subject to Availability

Shore Points are redeemable only for the corresponding food item described above at participating Jersey Mike’s locations; no substitutions are permitted. If you add other items or purchase a combo meal so that the purchase amount exceeds the value of the tendered Shore Points, you will be required to pay such difference in price. Redemption of rewards will reduce the points in your Shore Points account by the reward amount. THE PROGRAM AND ALL REWARDS SHALL BE USED AND ACCEPTED ON AN “AS IS” BASIS AND FOR WHICH SPONSOR MAKES NO WARRANTIES OR REPRESENTATIONS NOR ACCEPTS ANY RESPONSIBILITY.

Shore Points are non-transferable or assignable, except by JMFS. Shore Points are not property and you have no vested right or interest in points. Shore Points IDs and Shore Points have no cash value and are not redeemable for cash or gift cards, except where required by law. No portion of any qualifying purchase constitutes consideration paid for any Shore Points, reward, or other promotional benefit. Shore Point values will not be replaced if the Shore Points ID are used without permission. Sale of Shore Points IDs is strictly prohibited. JMFS is not responsible for honoring invalid Shore Points IDs.

By enrolling in the Program, you agree to these Terms. JMFS reserves the right, and each holder of a Shore Points ID agrees that, JMFS may cancel or limit the Program, modify the terms of the Program or the benefits awarded thereunder, and/or contract with a third party to administer the Program at any time, without notice to you, even if doing so affects your ability to use Shore Points that you may have already accumulated. This includes modifying, altering, adding or deleting program benefits, point values, redemption levels, reward delivery methods, expiration policies, and conditions for active status. You are responsible for periodically visiting this site to view any changes to these Terms. In the event that the Program is discontinued, you will be allowed to redeem Shore Points remaining on their Shore Points ID unless otherwise notified by JMFS. JMFS reserves the right to verify eligibility and to adjudicate on any dispute at any time.

The Program is governed by, and construed in accordance with, the laws of the State of New Jersey, without giving effect to any choice of law or conflict of law rules (whether of the State of New Jersey or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New Jersey.

Cancellation of Program Participation

You may cancel your Shore Points ID at any time by deleting your account within the mobile app or by contacting us at shorepoints@jerseymikes.com. Upon cancellation, any unused Shore Points and/or rewards accrued in your account will be forfeited and cannot be redeemed. If you delete your Shore Points account and subsequently re-enroll in the Program, your Shore Points will not carry over and your new Shore Points account will have a zero-point balance.

JMFS may revoke your account at any time, without notice, if you engage in abuse of the Program, unauthorized or fraudulent use of or tampering with the Program, failure to follow these Terms, the sale or barter of Shore Points, certain inactivity, or other improper conduct as determined by JMFS, in its sole judgment. Such conduct may also result in your future disqualification from Program participation (including ability to re-enroll in the Program or any variations thereof) and forfeiture of all points previously accrued. Shore Points and rewards are subject to applicable government regulations and are void where prohibited by law.

Mandatory Dispute Resolution for Registered Users (Individual Arbitration; No Court Trial; No Jury; No Class Action)

Any legal or equitable dispute between you and JMFS and/or its franchisees relating in any way to this Website is a “Claim.” Claims can arise under federal or state law, and can assert violations of statute, breach of contract, torts, frauds, and/or misrepresentations, among other things.

Excepted Claims

Individual claims that can be brought and completely resolved in small claims court and/or claims related to the ownership of JMFS intellectual property are “Excepted Claims.”

Covered Claims

All Claims, other than Excepted Claims, are Covered Claims.

JAMS as Arbitrator

You and we agree to mandatory, binding arbitration of Covered Claims by JAMS at a location surrounding Monmouth County, New Jersey. More information about JAMS can be found at https://www.jamsadr.com/.

Any arbitration must be filed with JAMS at https://www.jamsadr.com/submit/ or by such means as JAMS makes available. All issues are for JAMS to decide, except that a court must adjudicate "Excepted Claims" and disputes identified in the "Related Court Proceedings" section above (if you and we cannot agree). You agree to JAMS providing an arbitrator selection list. The arbitrators named on the selection list, and the arbitrator who is ultimately selected, must have relevant subject matter experience to the extent that JAMS has such arbitrators available.

Related Court Proceedings

You and we agree to be subject to the personal jurisdiction of the courts of New Jersey with respect to any Covered Claim. You and we submit to the jurisdiction of the federal and state courts surrounding Monmouth County, New Jersey to (1) enforce the terms of this Mandatory Dispute Resolution Agreement, (2) to address disputes regarding the scope, application, and enforceability of these Mandatory Dispute Resolution Terms, (3) for the appointment of a substitute arbitrator as needed (see below), and (4) to enter any award rendered by the arbitrator.

Rules to Apply

JAMS will adjudicate the Covered Claims in accordance with its Comprehensive Arbitration Rules & Procedures.

No Class, Mass, or Collective Actions or Arbitrations

You and we agree not to bring or participate in any class, mass, or collective action or arbitration regarding a Claim. You and we agree that JAMS only has authorization to conduct arbitration of Covered Claims on an individual basis. You and we do not give JAMS permission to arbitrate Your claim in conjunction with any Claim asserted by anyone else.

Substitute Arbitrator

In the event that JAMS cannot or will not perform arbitration in accordance with the provisions of this agreement, either (a) the parties may agree to another arbitrator or, if no such agreement is had, (b) a court shall appoint one according to the provisions of the Federal Arbitration Act, 9 U.S. Code § 5.

Remedies

Without limitation to other available remedies, the prevailing party in the arbitration or other proceeding pursuant or related to these Terms of Use shall be entitled to an award of reasonable attorneys' fees and costs. You and we waive the right to seek punitive, exemplary, or related forms of damages.

Jury Trial Waiver

If a claim proceeds in court rather than through arbitration, YOU AND WE EACH WAIVE ANY RIGHT TO A JURY TRIAL.

Marketing SMS Terms & Conditions

Jersey Mike's customers have the opportunity to opt in to receive Program rewards information and marketing communications from Jersey Mike's, which may include both short message service (SMS) and multimedia message service (MMS) functionality. By opting to receive text messages from us, you agree to be bound by these Marketing SMS Terms and Conditions, as well as our current Terms of Use (including, without limitation, your agreement to arbitration on an individual basis) and Privacy Policy, and any other applicable terms and agreements to which you agree, which are hereby incorporated hereto and made a part of the Program.

How to Opt-In to Marketing Messages

To receive promotional and personalized marketing text messages, push notifications, offers, discounts, and other information related to the Program, text JOIN to JMSUBS (567827) from your mobile device. You may also provide your phone number through your MyMike’s account online or in the mobile app, and opt into receiving marketing communications. Alternatively, you may be asked whether you are interested in receiving text messages the next time you come into a Jersey Mike’s location. Regardless of the way in which you opt into these communications, by choosing to receive text messaging updates from us, you agree to these Marketing SMS Terms and Conditions.

You must be a U.S. resident that is at least 13 years old to enroll. You agree that by enrolling in text messaging from us, you represent that you are the account holder for the mobile telephone number(s) that are used to opt-in to text messaging or that you otherwise have authorization to enroll the mobile telephone number(s) in such communications. You’ll receive texts from us to the telephone number you provide until you opt out.

The Program Terms, as stated above, are hereby incorporated into these Marketing SMS Terms & Conditions in full, including the agreement to resolve any disputes only by individual arbitration.

By subscribing to Jersey Mike’s text messaging, you consent to receiving text messages for marketing purposes from, or on behalf of Jersey Mike’s, at the mobile number you provide to us, via short code, even if your mobile telephone number is registered on any state or federal “Do Not Call” list. These messages may be sent using an automated system or an autodialer or automatic telephone dialing system at any time of day. This consent is not a condition of (and will apply whether or not you are) purchasing any property, goods, or services. We may alter the frequency of messages sent to you at any time.

We do not charge any separate fee for your participation in any text messaging from us. However, messaging and data rates may apply to each text message sent or received, as determined by your mobile telephone service plan.

Your Ongoing Requirements

You must notify us immediately if you change, transfer, or intend to stop using the mobile telephone number associated with your MyMike’s account and/or used to subscribe to marketing text messages. Your agreement to do so is a material part of these Marketing SMS Terms & Conditions. Failure to complete the opt-out process or notify us upon a change, transfer, or intent to stop using your mobile phone number will require you to indemnify Jersey Mike’s in full for all claims, expenses, and damages related to or arising under the Telephone Consumer Protection Act or similar laws.

To Opt Out of Text Messaging

If you would like to stop receiving marketing texts from us, please text STOP to JMSUBS (567827). After doing so, you may receive one additional message confirming that your request to opt-out has been processed.

Please note that if you opt out from receiving text messages from us, you may still receive marketing email messages (if you have opted into receiving such messages through your communication preferences in your MyMike’s account). You must opt out of these methods of communication directly in order to stop receiving them. You may also receive text messages related to your orders or transactions placed online, through your MyMike’s account, or in-store at a Jersey Mike’s location.

Communications from Franchises

Many Jersey Mike’s Restaurants are independently owned and operated by franchisees. These Marketing SMS Terms & Conditions do not apply to any separate text messaging marketing programs offered by those franchisees. If you receive text messages from a franchisee and wish to opt-out of the communications, you must do so directly through the respective franchisee.
