ELIGIBILITY

The Customer Appreciation Instant Win Sweepstakes (“Promotion”) is open only to natural persons who are legal residents of the fifty (50) United States (and the District of Columbia) who have a valid social security or tax ID number, who are at least eighteen (18) years old and who are members of Jersey Mike’s Shore Points® Rewards Program, at the time of entry. VOID IN PUERTO RICO, U.S. VIRGIN ISLANDS, AND OTHER U.S. TERRITORIES AND POSSESSIONS, AND WHEREVER PROHIBITED OR RESTRICTED BY LAW. Promotion may only be entered from and in eligible jurisdictions. Sponsor, its parent, subsidiary and affiliate companies, employees, agents and suppliers, and the immediate family (spouse, parents, siblings and children) and household members of each such person are not eligible to participate or win any Prize. Sponsor may request any potential Prize winner to provide proof that such person is the winner. All potential winners are subject to verification by Sponsor before any Prize will be awarded. By participating in the Promotion, entrant fully and unconditionally agrees and accepts these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Promotion. Winning a Prize is contingent upon fulfilling all requirements set forth herein.

SPONSOR

The Sponsor of the Promotion is Jersey Mike's Franchise Systems, Inc., 2251 Landmark Place Manasquan, NJ 08736 (“Sponsor”).

PROMOTION PERIOD

The Promotion period begins at 12:00 AM Eastern Time (“ET”) on August 1, 2022 and ends at 11:59 PM ET on August 31, 2022 (“Promotion Period”). For purposes of this Promotion, a “day” begins at 12:00 AM ET and ends at 11:59 PM ET. Sponsor’s computer is the official time keeping device of the Promotion.

HOW TO ENTER

There are two (2) ways to enter: 

With the Purchase of a Jersey Mike’s Sub

For every order that includes a Jersey Mike’s sub sandwich and is placed during the Promotion Period (1) at a Jersey Mike’s restaurant; (2) through the Jersey Mike’s app; (3) through the Jersey Mike’s website; or (4) through a third-party delivery/pickup platform so long as the entrant registers such third-party order to his or her MyMike’s account through the Jersey Mike’s website, the entrant earns one (1) Instant Win Prize (“Prize”). Each Prize contains a number of bonus Shore Points: either 6 points, 12 points, 36 points or 72 points. A qualifying order will prompt a push notification from the Jersey Mike’s app, if push notifications are enabled; if not, a link to open the Prize in the Jersey Mike’s app will be emailed to the entrant’s email account. The entrant must click on the Prize in the Jersey Mike’s app to “open” it. The Prize must be opened in order for the points to be applied to the entrant’s MyMike’s account.

Once the Prize is opened, the entrant will see how many Shore Points are in the Prize and they will be applied to the entrant’s account. Prizes that are not opened by December 31, 2022 will be unredeemable.

Free Online Method of Entry

During the Promotion Period, to enter without making a purchase, mail-in a postcard to Jersey Mike’s Franchise Systems, Inc., 2251 Landmark Place, Manasquan, New Jersey 08376, Attention: JM Awards, with your telephone number or email address. Once your postcard is received and processed, you can obtain your Prize in the Jersey Mike’s app.

For All Entries

Each entrant is eligible to receive up to 5 Prizes (including those received through the Free Online Method of Entry) per day during the Promotion Period, regardless of method or combination of methods of entry or number of entries submitted. Multiple entrants are not permitted to share the same email address or other relevant account. Any attempt by any entrant to obtain more than the stated number of Prizes by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that entrant’s entries and that entrant may be disqualified. Use of any repetitive, automatic, programmed or similar technology, system or agent (including without limitation promotion entry services) to enter is prohibited and will void all Prizes by that entrant. Any automated receipt (such as one confirming delivery of text message or e-mail) does not constitute proof of actual receipt by Sponsor of an entry. The Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible or misdirected Prizes, which will be disqualified.

PRIZING

PRIZES ARE LIMITED DURING THE PROMOTION PERIOD. The daily limit on each point value is as follows: (1) 72 point Prizes – maximum 250, (2) 36 point Prizes – maximum 1,000, (3) 12 point Prizes – maximum 2,500, (4) 6 point Prizes are not limited. The total Approximate Retail Value (“ARV”) of the instant win promotion depends upon the number of purchases made through the Jersey Mike’s App and the number of corresponding points awarded to customers and then redeemed. The estimated maximum ARV for the entire promotion is $3,989,346.78. The Shore Points are redeemable for food only at Jersey Mike’s restaurants or through online purchases via the Jersey Mike’s app or website. Except as required by law, Shore Points are not redeemable or exchangeable for cash, check, or credit. Odds of winning an Instant Win Prize depend on the number of points available divided by the number of eligible Instant Win Prize purchases or plays. Prizes are non-transferable, and no substitution will be made except as provided herein at the Sponsor’s sole discretion. Winners are responsible for all taxes and fees associated with Prize receipt and/or use. Prize Shore Points will be applied to the entrant’s MyMike’s account within forty-eight (48) hours after the entrant opens the Prize.

WINNER SELECTION

The Prize will be selected at random by a computer from among the four (4) Prizes, in each case until the number of available Prizes is depleted.

PUBLICITY

Except where prohibited, participation in the Promotion constitutes entrant’s consent for Sponsor to use entrant’s name, likeness, voice, opinions, hometown and state for promotional purposes in any media, worldwide, without further payment or consideration.

PRIVACY

Information submitted by entrants will be collected by Sponsor’s systems based in the United States and such collection will be subject to applicable United States laws. Entrants may withdraw personal data upon request; however, Shore Points will be disqualified if personal data is withdrawn prior to the redemption of the points. Information submitted by entrants is subject to Sponsor’s privacy policy. Entrant’s participation in this Promotion constitutes consent for Sponsor to use entrant’s personal information solely for the purpose of administering the Promotion and awarding the Prizes, unless entrant has opted to receive e-mail communications from Sponsor. ERRORS AND UNAUTHORIZED ACTIVITIES

In the event that the operation, security, or administration of the Promotion is impaired in any way for any reason, including without limitation, fraud, virus or other technical problem, Sponsor may, in its sole discretion, either: (a) suspend the Promotion to address the impairment and then resume the Promotion in a manner that best conforms to the spirit of these Official Rules; or (b) cancel or terminate the Promotion. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Promotion or to be acting in violation of the Official Rules of this or any other promotion, or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Promotion may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any provision of these Official Rules shall not constitute a waiver of that provision.

RELEASE

Except where prohibited, by participating in the Promotion, entrant releases Sponsor, promotional agencies, franchisees, and each of their respective parent companies, affiliates, subsidiaries, successors, assigns, contractors, agents, representatives, officers, directors, shareholders, and employees, (collectively “Released Parties”), from and against any and all liability for any claims, costs, injuries, losses or damages of any kind arising in connection with the Promotion, including without limitation (a) the unauthorized or illegal access to personally identifiable or sensitive information; (b) acceptance, possession, use, misuse, or nonuse of the Prize that may be awarded; (c) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Promotion; (d) technical and/or communications malfunctions, errors or failures of any kind; (e) unauthorized human intervention in any part of the Promotion; (f) technical or human error which may occur in the administration of the Promotion or the processing of entries; (g) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Promotion or receipt or use or misuse of any Prize; (h) if Sponsor must cancel or terminate the Promotion for any reason; or (i) if any Prize cannot be awarded due to circumstances beyond Sponsor’s control. Entrant agrees that in any cause of action, the Released Parties’ liability shall be limited to the cost of entering and participating in the Promotion and in no event shall the Released Parties be liable for attorneys’ fees or other legal or enforcement costs.

Entrant acknowledges that the Sponsor has neither made nor is in any manner responsible or liable for any representation, warranty or guarantee, expressed or implied, in fact or in law, relative to a Prize including, without limitation, the Prize quality or availability.

RESERVATION OF RIGHT TO CANCEL OR MODIFY

Sponsor reserves the right to cancel or modify the Promotion if fraud, misconduct or technical failures threaten the integrity of the promotion; or if a computer virus, bug, or other technical problem corrupts the administration or security of the Promotion as determined by Sponsor; or any other reason in Sponsor’s sole discretion requires modification or cancellation of the promotion. Exercise of this right to cancel or modify is in Sponsor’s sole discretion.

DISPUTES

As a condition of participating in the Promotion, entrant agrees that any and all disputes, claims and causes of action arising out of or in connection with this Promotion or any Prizes awarded shall be resolved individually, without resort to any form of class action, exclusively by mandatory, binding arbitration by the American Arbitration Association (“AAA”). Entrant further agrees that under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim any damages whatsoever including, without limitation, punitive, consequential, direct or indirect, or any other damages. Sponsor reserves the right to modify Prize award procedures. All issues and questions concerning the validity, construction, interpretation, performance, and enforcement of the Promotion and these Official Rules, or the rights and obligations of the entrant and Sponsor, shall be governed by and construed in accordance with the laws of New Jersey, without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than New Jersey.
